1 · These Terms

These Terms of Use (“Terms”) govern the website at fathandco.com (the “Site”), operated by Fath&Co B.V., Nieuwstraat 49, 4331 JK Middelburg, The Netherlands, KvK 98855670 (“Fath&Co”). These Terms apply to your use of the Site. A link to them appears on every page.

2 · Purpose; no offer

The Site provides general information about Fath&Co, for institutional and professional audiences. Nothing on it is investment, financial, legal or tax advice, a recommendation, or an offer or solicitation of any security, financial instrument or investment activity, in any jurisdiction; it is not directed at any person where its availability would be unlawful. The Legal Notice sets out Fath&Co’s regulatory status and should be read together with these Terms.

3 · Intellectual property; permitted use

The Site’s content and design, the Fath&Co name, logomark, wordmark and the motto “Backing those who build” are owned by or licensed to Fath&Co and protected by copyright, trade name and other applicable rights. You may view the Site and print or save its pages for personal or internal reference; statutory exceptions are not affected. Any other use, including use of the name or marks, requires our prior written consent.

4 · Automated access; text and data mining

You must not interfere with the Site’s operation, attempt unauthorised access, or use automated means beyond ordinary search-engine indexing to access or extract its content. Fath&Co expressly reserves all rights in the Site’s content for text and data mining (Article 4(3) of Directive (EU) 2019/790; Article 15o of the Dutch Copyright Act). Without our prior written consent, the Site’s content may not be reproduced or extracted for text and data mining, including to train or develop artificial-intelligence models or to compile datasets.

5 · Accuracy; links

The Site is provided “as is” and “as available”, without representation or warranty as to accuracy, completeness or currency; content may change or be withdrawn at any time. Links to third-party websites are provided for convenience only; we do not control or endorse them and accept no responsibility for them.

6 · Liability

To the extent permitted by law, Fath&Co is not liable for any indirect, consequential, special or incidental loss, or loss of profit, data or goodwill, arising from use of the Site, and its aggregate liability for any claim or series of connected claims arising from the Site shall not exceed EUR 100. Nothing in these Terms excludes or limits liability for intent or deliberate recklessness (opzet of bewuste roekeloosheid) of Fath&Co or its managerial staff, or any other liability that cannot be excluded under Dutch law.

7 · Changes; severability

We may amend these Terms; the version published at the time of your visit applies, and the date above shows when they were last updated. If any provision is invalid, the remaining provisions stand, and the invalid one is deemed replaced by a valid provision that most closely reflects its purpose.

8 · Governing law; contact

Dutch law governs these Terms and any non-contractual obligations connected with them. Disputes belong before the competent Dutch court. Questions may be sent to contact@fathandco.com.
